Booking Terms and Conditions

At Aviation Tours, we are committed to delivering exceptional, all-inclusive journeys to some of the most remarkable destinations in Australia and beyond.

These Terms and Conditions set out the agreement between you and Aviation Tours Pty Ltd ACN 693 583 578. By making a booking with us, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions.

Nothing in this agreement excludes, restricts or modifies any rights you may have under the Competition and Consumer Act 2010 or the Australian Consumer Law.

Aviation Tours Pty Ltd is referred to as Aviation Tours, we, us or our in this document.

  1. Authority and Application

These Terms and Conditions apply to you and to any person for whom you make a booking, including minors or persons under your care.

If you make a booking on behalf of another person, you warrant that you are authorised to accept these Terms and Conditions on their behalf and that you have full authority to bind them to this agreement. You agree to indemnify Aviation Tours for any loss arising from a failure to obtain such authority.

References to Aviation Tours include our directors, pilots, employees, contractors, agents and affiliated service providers. All protections, exclusions and limitations extend to them.

  1. The Nature of Touring and Operational Flexibility

Our tours operate in diverse and often remote environments and involve aircraft operations that are subject to regulatory, safety and environmental considerations.

You acknowledge that travel of this nature involves inherent risks and operational variables. These may include weather conditions, air traffic control requirements, aircraft availability, government directives, supplier constraints or other events beyond our reasonable control.

While we will always use our best endeavours to deliver the published itinerary, Aviation Tours reserves the right to modify aircraft type, routing, accommodation, transport or scheduled activities where reasonably required for safety, regulatory or operational reasons.

Any such adjustments made in good faith do not constitute a breach of contract.

  1. Minimum Numbers and Tour Changes

Certain tours are subject to minimum guest numbers. Aviation Tours reserves the right to cancel a departure if minimum numbers are not met.

If Aviation Tours cancels a tour prior to departure for reasons within our control, your entitlement is limited to a refund of monies paid directly to Aviation Tours.

To the maximum extent permitted by law, Aviation Tours is not liable for consequential loss, including but not limited to additional travel arrangements, accommodation, insurance excesses or loss of enjoyment.

  1. Bookings and Payment

A booking is confirmed only upon receipt of the required deposit and written confirmation from Aviation Tours.

Deposits are non-refundable.

The balance of the tour price must be paid no later than 60 days prior to departure. If payment is not received by the due date, Aviation Tours reserves the right to treat the booking as cancelled and apply the applicable cancellation terms.

All prices are subject to change prior to confirmation due to variations in fuel pricing, regulatory charges, taxes or supplier costs.

Book and Pay Now promotional fares require full payment at the time of booking and remain subject to the cancellation terms outlined below.

  1. Guest Cancellation

All cancellations must be submitted in writing.

The following cancellation terms apply:

More than 60 days prior to departure – Loss of deposit.

Between 30 and 60 days prior to departure – Fifty percent of the total tour price plus any unrecoverable third-party costs incurred.

Less than 30 days prior to departure – One hundred percent of the total tour price.

No refund will be provided for unused services, voluntary withdrawal from a tour, late arrival or early departure.

Where Aviation Tours has committed funds to third party providers on your behalf, you agree to reimburse those unrecoverable costs.

  1. Travel Insurance

Comprehensive travel insurance is strongly recommended and remains your responsibility.

Tour pricing does not include coverage for cancellation, medical expenses, evacuation, personal belongings or travel disruption. Aviation Tours is not responsible for losses of this nature.

  1. Health and Medical Responsibility

Guests must ensure they are medically fit to undertake the tour. You warrant that you do not suffer from any condition that would prevent safe participation.

Our journeys may involve travel to regional or remote areas where medical services are limited.

You authorise Aviation Tours to arrange medical assistance, evacuation or emergency treatment if reasonably necessary. All associated costs are your responsibility.

Aviation Tours is not liable for illness, injury or death except to the extent caused by our proven negligence and only to the extent such liability cannot be excluded under Australian Consumer Law.

No refund is payable for any portion of a tour missed due to medical circumstances outside our control.

  1. Limitation of Liability

To the fullest extent permitted by law:

Aviation Tours excludes liability for any indirect, incidental or consequential loss including loss of enjoyment, loss of opportunity or additional expenses incurred.

Where services supplied are not ordinarily acquired for personal, domestic or household use, liability for breach of any non-excludable guarantee is limited, at our option, to the resupply of the services or the cost of having them supplied again.

Aviation Tours acts as an agent for aircraft operators, accommodation providers and third party operators where applicable and is not responsible for their acts or omissions.

  1. Guest Conduct

Aviation Tours is committed to providing a refined and respectful group travel environment.

Guests must comply with all lawful directions given by our pilots, crew and representatives. Behaviour that is unsafe, unlawful, disruptive or detrimental to the comfort or safety of others may result in immediate termination of participation in the tour without refund.

  1. Force Majeure

Aviation Tours is not liable for failure or delay in performance caused by events beyond our reasonable control, including natural disasters, government restrictions, pandemics, industrial action or aircraft unavailability.

In such circumstances, refunds or credits will be provided only to the extent that Aviation Tours is able to recover funds from suppliers.

  1. Photography and Marketing

You grant Aviation Tours permission to use photographs or video footage taken during the tour for marketing and promotional purposes without compensation.

If you do not consent, written notice must be provided prior to departure.

  1. Privacy

Your personal information is handled in accordance with our Privacy Policy, which should be read in conjunction with these Terms and Conditions and is available on our website.

  1. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia. Any dispute arising in connection with a booking shall be subject to the exclusive jurisdiction of the courts of Queensland.

  1. Acceptance

Your booking is confirmed upon signing these Terms and Conditions or accepting them electronically during the booking process.

By proceeding with a booking, you acknowledge that you have read, understood and agreed to be legally bound by this agreement.
